By signing in, creating an account, or using Nearby - Free Random chat, you agree to these Terms. If you do not agree, do not use the Service.
1. About the Service
Nearby - Free Random chat, also referred to as SecureDateNearby, is an adult social discovery app that supports nearby discovery, rich dating profiles, compatibility quiz matching, encrypted messaging, media/file sharing, encrypted voice notes, and encrypted audio/video calls. The Service uses a broker server for presence, discovery, signaling, push wakeups, encrypted offline queues, encrypted friend/block backup, reports, and operational safety.
2. Eligibility
You may use the Service only if:
- You are at least 18 years old.
- You have legal capacity to agree to these Terms.
- You are not prohibited from using the Service under applicable law.
- You have not been banned, tombstoned, or removed from the Service.
Strictly 18+. If we learn that an account belongs to a minor, or that an account is used to involve a minor in sexual, exploitative, deceptive, or unsafe conduct, we may immediately delete, ban, and report it.
3. Your Identity and Account
- You sign in and access your account using Google Sign-In. Your account is a cryptographic identity generated on your device; signing in with the same Google account lets you access it from any device.
- An encrypted backup of your account's key material is held on our server so you can recover your account after signing in with Google on a new or reinstalled device, even if you lose your original device. See our Privacy Policy and Data Policy for exactly what this involves and how it is protected.
- You are responsible for keeping your Google account secure, and for your device, profile, messages, media, calls, and conduct.
- You must provide an accurate age and must not misrepresent yourself in a way that harms, deceives, or endangers others.
- You may not create accounts for minors, impersonate others, evade bans, automate signups, or sell/transfer accounts.
- Accounts are identified by your Google sign-in, not by device. Deleting your own account removes the link to your Google account, so that Google account is free to be used to create a new one; an account we ban or remove for a policy violation does not release this link.
- Accounts inactive for an extended period may be deleted or tombstoned as described in our policies.
4. Acceptable Use
You may use the Service to discover nearby adults, build a profile, answer optional compatibility questions, send encrypted messages and media, exchange encrypted voice notes, and make encrypted calls with consenting adult users.
Compatibility percentages and profile information are informational only. They are not guarantees of safety, identity, compatibility, relationship outcome, or truthfulness.
5. Prohibited Conduct
5.1 Child safety and illegal sexual content
- Creating, sharing, requesting, linking to, describing, facilitating, or possessing child sexual abuse material (CSAM) or child sexual abuse/exploitation (CSAE).
- Sexualization of minors, including text, images, synthetic/AI-generated depictions, roleplay, grooming, or sextortion.
- Using the Service to contact, lure, coerce, exploit, traffic, or endanger a minor.
- Any account belonging to, controlled for, or used by a person under 18.
5.2 Abuse, harassment, and consent violations
- Harassment, threats, stalking, intimidation, hate, abuse, or coordinated attacks.
- Unsolicited sexual content or pressure after someone says no, blocks, ignores, or does not consent.
- Non-consensual intimate imagery, revenge porn, sexual blackmail, or doxxing.
- Sharing another person's private information without consent.
5.3 Fraud, deception, and platform abuse
- Impersonation, fake profiles, scams, phishing, financial fraud, romance scams, or extortion.
- Spam, commercial solicitation, MLM schemes, bots, scraping, mass messaging, or automated discovery harvesting.
- Reverse engineering, attacking, load testing without permission, bypassing rate limits, exploiting bugs, or interfering with servers, peers, TURN/R2/FCM providers, or other infrastructure.
- Uploading malware, harmful files, illegal content, or content that infringes another person's rights.
6. User Content and Encrypted Communications
You retain ownership of your content. You are solely responsible for what you publish, send, record, upload, or say through the Service.
- We cannot proactively read or moderate end-to-end encrypted messages, ordinary attachments, voice-note plaintext, or call media.
- We can review visible profile fields, reports, operational metadata, and information you voluntarily provide in reports or support requests.
- You must not use encryption, offline delivery, files, voice notes, or calls to violate these Terms or applicable law.
- Recipients may save, screenshot, export, or share content outside the Service. Use judgment before sharing sensitive information.
7. Blocking, Reporting, and Enforcement
- Block: Blocking removes the relationship locally and makes your app reject that user's future requests, messages, and calls. Because the server cannot read your encrypted block list, blocking may not fully hide an otherwise public discovery profile from the blocked person.
- Report: You may report users for spam/scam, harassment, fake profile, inappropriate content, suspected underage use, or other concerns. Reports include optional details you type and metadata needed for review.
- Enforcement: We may warn, limit, suspend, delete, ban, tombstone, or report accounts based on violations, safety risks, reports, law, or infrastructure abuse.
For confirmed or credible child-safety concerns, we may act faster than ordinary report timelines and may report to appropriate authorities.
8. Privacy and Data
Our Privacy Policy, Data Policy, and Child Safety Standards form part of these Terms. They explain current data flows, retention, encrypted storage, third-party providers, reports, and account deletion.
9. Permissions and Device Features
The app may request permissions for location, notifications, camera, microphone, media access/saving, foreground call service, full-screen call UI, battery optimization exemption, wake lock, Bluetooth/audio behavior, and internet access. Some features will not work if you deny required permissions.
10. Account Deletion, Wipe, and Export
You may export non-key local data, wipe this device, or delete your account from Settings. Account deletion removes active server data we control, attempts to notify current/pending contacts, attempts to delete outstanding encrypted voice-note uploads, and wipes this device. A minimal tombstone may remain to prevent reactivation or ban evasion. Reports, safety records, provider logs, and legal records may remain as described in our policies.
Deleting your account does not remove content already delivered to another user's device.
11. Intellectual Property
The Service, brand, design, source code, interfaces, and original materials are owned by us or licensed to us. Open-source dependencies remain governed by their own licenses. You may not copy, modify, distribute, scrape, or create derivative works from the Service except as permitted by law or written permission.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, AVAILABLE IN ALL LOCATIONS, OR THAT PEOPLE YOU MEET ARE WHO THEY CLAIM TO BE.
The Service is a communication tool. Use common sense, meet safely, keep your Google account secure, and do not rely on the Service as a substitute for personal judgment, emergency services, identity verification, legal advice, or professional advice.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SECUREDATENEARBY AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, LOST PROFITS, LOSS OF GOODWILL, PERSONAL DISPUTES, USER CONDUCT, OR THIRD-PARTY ACTIONS ARISING FROM USE OF THE SERVICE.
Our total liability for claims relating to the Service will not exceed INR 500 or the amount you paid us in the 12 months before the claim, whichever is greater.
14. Indemnification
You agree to defend, indemnify, and hold harmless Nearby - Free Random chat (SecureDateNearby) and its operators from claims, damages, costs, and expenses arising from your use of the Service, your content or conduct, your violation of these Terms, or your violation of another person's rights.
15. Termination
We may suspend, delete, ban, tombstone, or restrict access to any account that violates these Terms, creates safety risk, abuses infrastructure, or is legally required to be removed. We may discontinue or modify the Service at any time.
Sections concerning prohibited conduct, privacy/data, intellectual property, disclaimers, limitation of liability, indemnification, termination, and governing law survive termination.
16. Governing Law and Disputes
These Terms are governed by the laws of India. Courts of competent jurisdiction in India will have jurisdiction, subject to applicable law. Before filing a claim, contact [email protected] so we can try to resolve the issue informally.
17. Changes
We may update these Terms as the app changes. Material changes may be shown in-app or on this page. Continued use after changes take effect means you accept the updated Terms.
